National Action Plans on business and human rights are a growing phenomenon. Since 2011, 42 such plans have been adopted or are in-development worldwide. By comparison, only 39 general human rights action plans were published between 1993 and 2021. In parallel, NAPs have attracted growing scholarly interest. While some studies highlight their potential to advance national compliance with international norms, others criticise NAPs as cosmetic devices that states use to deflect attention from persisting abuses and needed regulation. In response to (...) wider critiques of international human rights norms, and their failure to exact universal state compliance, experimentalist governance theory highlights the dynamic, dialogic and iterative character of human rights implementation as well as the role of stakeholders. In this article, we apply experimentalist governance theory to evaluate the role and character of business and human rights NAPs. Rather than attempting to evaluate NAPs’ ultimate consequences for rights-holders, which appears premature, we focus on NAPs processes. Specifically, we analyse NAPs processes in twenty-five states against five experimentalist governance criteria relating to stakeholder participation; agreement on a broad problem definition; local contextualisation; monitoring and peer review and periodic revision and learning. According to our findings, NAPs on business and human rights in most states demonstrate resemblance to the traits of experimentalist governance. In particular, our analysis points to the emergence of relatively sophisticated and demanding institutional governance mechanisms within NAPs — including the institutionalisation of complex deliberative processes. Nevertheless, our paper also identifies some significant shortcomings in NAPs, related to the lack of inclusion of vulnerable groups and the lack of explicit indicators and targets. (shrink)

Prompted by the development of the Theory of Challenge and Threat States in Athletes (Jones et al, 2009), recent years has witnessed a considerable increase in research examining challenge and threat in sport. This manuscript provides a critical review of the literature examining challenge and threat in sport, tracing its historical development and some of the current empirical ambiguities. In an attempt to reconcile some of these ambiguities, and utilising neurobiological evidence associated with approach- and avoidance-motivation (cf. Elliot & Covington, (...) 2001), this paper draws upon the Evaluative Space Model (ESM: Cacioppo et al., 1997) and considers the implications for understanding challenge and threat in sport. For example, rather than see challenge and threat as opposite ends of a single bipolar continuum, the ESM implies that individuals could be (1) challenged, (2) threatened, (3) challenged and threatened, or (4) neither challenged or threatened by a particular stimulus. From this perspective it could be argued that the appraisal of some sport situations as both challenging and threatening could be advantageous, whereas the current literature seems to imply that the appraisal of stress as a threat is maladaptive for performance. In drawing upon the ESM, we outline the Evaluative Space Approach to Challenge and Threat and provide several testable hypotheses for advancing understanding of challenge and threat (in sport). We also outline a number of cardiovascular and experiential measures that can be used to examine these hypotheses. In sum, this paper provides a significant theoretical, empirical and practical contribution to our understanding of challenge and threat (in sport). (shrink)

This commentary questions the applicability of the Newell Test for evaluating the utility of connectionism. Rather than being a specific theory of cognition (because connectionism can be used to model nativist, behaviorist, or constructivist theories), connectionism, we argue, offers researchers a collection of computational and conceptual tools that are particularly useful for investigating and rendering specific fundamental issues of human development. These benefits of connectionism are not well captured by evaluating it against Newell's criteria for a unified theory of cognition.

Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. Scholars of color have been instrumental in advancing nursing knowledge development but find limited spaces where one can authentically share their philosophical perspective. Although there is a call for antiracism in nursing and making way for more diverse and inclusive theories and philosophies, our voices remain at the margins of nursing theory and philosophy. In nursing philosophy, there continues to be a lack of racial diversity in those who are given the platform to share their scholarship. Five nurse scholars of (...) color attended the International Nursing Philosophy Conference in August 2022. We established a collective system of support by sharing our experiences as researchers, scholars, and educators with each other. The theory of emancipatory nursing praxis informed this process. In this dialogue, we reflected on what it is like to present at and attend predominantly white nursing conferences. We shared our experiences of how we exist as nurse scholars, our philosophical views, and our thoughts on how we create spaces where scholars of color can feel welcomed and acknowledged for their contributions to advancing nursing knowledge. En 1960, la Préface de Signes semble reconduire le constat, attestant cette fois de l’échec des philosophies de l’histoire dont les Aventures de la dialectique dessinaient le premier volet. Si la critique marxienne apparaissait contribuer à la clarté politique et constituer la réponse adéquate à une période de crise, quelle opportunité reste-t-il au (...) philosophe une fois la rupture avec le marxisme consommée? A l’abandon pur et simple de la philosophie politique suggéré par les interprètes et par le texte de Merleau-Ponty lui-même en certains endroits – « n’est-ce pas un incroyable malentendu si tous les philosophes ou presque se sont crus obligés d’avoir une politique? » (S, 13) – il faut préférer l’alternative de la philosophie militante, mentionnée à partir de 1956 en deux lieux textuels, seule issue possible d’une philosophie ayant abandonné ses droits au système sans se résoudre au mutisme – soit, dans une perspective encore marxiste, l’après devenir-monde de la philosophie. Comment dès lors conjuguer l’apparition du syntagme en 1946, où il semble réservé à la pensée de Marx par contraste avec la philosophie triomphante hégélienne, et son maintien hors du cadre de référence marxien, lorsque ce dernier est devenu, selon les dires de Merleau-Ponty lui-même, un auteur qu’il convient de méditer à la manière d’un classique? L’insuccès des pensées systématiques de l’histoire et des figures classiques de l’engagement (Sartre, Boukharine) dévoile la nécessité pour Merleau-Ponty d’interroger continument son expérience politique et la raison d’être de son militantisme, inscrit dans la chair de l’histoire.As the war ended, Merleau-Ponty considered that everything thought to be good and well thought – freedom, powers, citizenship – was in ruin. In 1960, the Preface to Signs seems to replicate this realization, attesting this time to the failure of philosophies of history of which Adventures of the Dialectic sketched the first phase. If the Marxist critique appeared to contribute to political clarity and to consist in an adequate response to a period of crisis, what opportunities remain for philosophy once the rupture with Marxism is finalized? To the pure and simple abandonment of political philosophy suggested by interpreters and by Merleau-Ponty’s text itself in certain instances – “Is it not an incredible misunderstanding that all, or almost all, philosophers have felt obliged to have a politics?” (S, 5) – one must favor the alternative of militant philosophy, first mentioned in 1956 in two textual locations. This alternative is the only outcome possible for a philosophy that has abandoned its rights to the system without resolving itself to silence. It is, from a still-Marxist perspective, the post becoming-world of philosophy. How, then, can we reconcile the appearance of the phrase in 1946 – where it seems reserved to Marxist thought in contrast with the triumphant Hegelian philosophy – with its retention outside of Marxist references, even as Marx has become, according to Merleau-Ponty himself, a writer who should be reflected upon as a classic? For Merleau-Ponty, the failure of systematic theories of history and of traditional figures of engagement (Sartre, Bukharin) reveals the necessity to continuously interrogate his own political experience and the ground of his militancy, inscribed in the flesh of history.Alla fine della guerra, Merleau-Ponty considerava che tutto ciò che credevamo ben fatto e ben pensato – la libertà e i poteri, la cittadinanza – fosse in rovina. Nel 1960, la Prefazione a Segni sembra ribadire questa constatazione, attestando questa volta il fallimento delle filosofie della storia di cui le Avventure della dialettica disegnavano la prima componente. Se la critica marxiana sembrava contribuire alla chiarezza politica e costituire la risposta adeguata a un periodo di crisi, quale opportunità resta al filosofo una volta consumata la rottura con il marxismo? All’abbandono puro e semplice della filosofia politica suggerito dagli interpreti, nonché in certi passaggi dei testi dello stesso Merleau-Ponty, bisognerebbe preferire l’alternativa della filosofia militante, menzionata a partire dal 1956 in due passaggi, sola via d’uscita possibile da una filosofia che ha ceduto i propri diritti al sistema e che però non vuole ridursi al mutismo. O invece, in una prospettiva ancora marxista, l’epoca successiva al divenire-mondo della filosofia. Come coniugare allora l’apparizione del sintagma nel 1946, apparentemente riservato al pensiero di Marx in contrasto con la filosofia hegeliana trionfante, con la sua salvaguardia fuori dal quadro di riferimento marxiano, dal momento in cui quest’ultimo è diventato, secondo lo stesso Merleau-Ponty, un autore sui cui è necessario riflettere alla maniera di un classico? L’insuccesso delle filosofie sistematiche della storia e delle figure classiche dell’impegno (Sartre, Bucharin) rivela la necessità per Merleau-Ponty d’interrogare continuamente la sua esperienza politica e la ragion d’essere della sua militanza, iscritta nella carne della storia. A filosofia com crianças, em todas as suas guisas, visa engendrar o pensamento filosófico e o raciocínio nas crianças. Muito é escrito sobre o que a participação na filosofia poderia fazer para a criança academicamente e emocionalmente. O que propomos aqui é que permitindo às crianças participar de diálogos filosóficos elas aprenderão uma abordagem que poderia dar suporte a sua participação na sociedade e que poderia envolvê-las na consideração e no arejamento de suas vistas, tomando decisões em suas interações e (...) relacionamentos com os outros. É inevitável que, vivendo com os outros, se encontrem os valores dos outros. É essencial, portanto, que as crianças aprendam como lidar com os valores dos outros mas também que elas aprendam como desenvolver os seus próprios pelo questionamento e a reflexão. Melhor que ensinar às crianças sobre os valores ou ensinar-lhes os valores que elas deveriam ter, este artigo sugere que às crianças deveriam ser proporcionadas oportunidades de explorar uma variedade de perspectivas e que elas precisam aprender a fazer isto. Além disso, no entanto, a fim de viver harmoniosamente com os outros, existem considerações sobre ética a serem encontradas. As crianças precisam aprender como lidar com política, arte, ciência, literatura e a maior variedade de problemas que a vida em sociedade inclui. De fato, as crianças precisam aprender o que é requerido para ser um cidadão. Aqui o aprendizado da criança é contextualizado no Currículo de Excelência da Escócia, no qual se espera das crianças que elas sejam capazes de “fazer escolhas e tomar decisões informadas” e de “desenvolver pontos de vista informados e éticos de problemas complexos” (Scottish Executive, 2004, p.12) como parte de sua educação para a cidadania. Se ser um cidadão envolve esses elementos, então existe um desafio para os professores no que concerne a como as crianças vão alcançar os resultados desejados. O objetivo de tal currículo é que a criança ‘aprenda para a vida’ adquirindo as competências para a vida de forma que a sociedade se beneficie. É colocado, neste artigo, que participando dos diálogos filosóficos uma pessoa é suscetível de favorecer uma apreciação dos outros e de suas perspectivas, de compreender que os valores e opiniões de alguém evoluem, que essa visão filosófica pode, de fato, funcionar para a melhora da sociedade. This book review discusses Walter O. Kohan and Barbara Weber's edited volume, Thinking, Childhood, and Time.

Due to a simplistic interpretation of the Holly Scriptures, the Christian world has for a long time largely rejected the Darwinian theory. It was therefore, even in the twenties of the post century, difficult to reconcile the idea of the common origin of all species and a superficial reading of the Book of Genesis. In this context, two catholic priests who were also scientist - Teilhard de Chardin and Henry de Dorlodot - tried to reconcile their scientific adhesion to Darwin's (...) theory and their faith to God. They held o similar scientific opinion but by different ways. In fact, they gat iota two opposite situations due to the very different receptions given to their claim: Teilhard de Chardin, severely repressed, was sent to China in order to prevent the diffusion of his ideas whereas de Dorlodat's book was published and acclaimed. This was probably due to the use mode by the second of times of on essentially theological argumentation in order to present the underlining scientific theory. Teilhard de Chardin developed his argumentation trough a scientific analysis ending up in philosophical and religious conclusions. On the other hand, some believing scientists were able to find in the de Dorlodot's argumentation the theological support for their knowledge that they needed. (shrink)

In a pioneering book, Philosophy of Microbiology, Maureen O’Malley argues for the philosophical importance of microbes through an examination of their impact on ecosystems, evolution, biological classification, collaborative behavior, and multicellular organisms. She identifies many understudied conceptual issues in the study of microbes. If philosophers follow her lead, the philosophy of biology will be expanded and enriched.

Conférences du Colloque de Millau (29 septembre-3 octobre 1993). Ed. "Les amis de sainte Claire aujourd'hui." Millau: Maury, 1994. 220 pp. During the eighth centenary of the birth of St. Clare, many symposiums were planned in France: Millau, Béziers, Montpellier, Perpignan and Paris. Sainte Claire en Rouergue presents most of the conferences from the (...) symposium of Millau, September 29 to October 3, 1993. This symposium celebrated the Franciscan presence in the region of Rouergue, France, during the last eight hundred years as well as the history and spirituality of St. Clare. Although the presentations were focused on a clearer history of the Poor Clares, they provided much information about the First Order as well as the Third Order Franciscan women of the nineteenth and twentieth centuries. The book presented a clear overview of the Franciscan foundations, devastations, and their re-establishment after the French Revolution and the disappearance of many communities. The first section highlighted the person of Saint Clare and her historical moment. The various articles provided an interesting review of many different dimensions: of Ladies in history in the 11th to the 13th century (Pernoud), the new religious structure begun by Clare (Dejour), her spirituality (Fabre) and the living of the Gospel by Francis and Clare (Dutheil). The direction of the symposium was not only to the past glories of Clare, but examined her place in social communication today (Gritti) and gave practical suggestions so as to concretize her spirituality and her influence in the future of Franciscan life (Miniou, Mercadier, Ghirard). The second section of the book focused on the history of the Franciscan presence in southwestern France. Information was gathered from many sources about the various branches of Franciscan life in Rouergue: Friars Minor, Coletans, Capuchins, Recollects, Cordeliers, Cordelières, Damianites, Minorettes, and Urbanists. The symposium presented different backgrounds and aspects of Franciscan life in Rouergue using archives, iconography, descriptions of artifacts and images, charts and maps. A more detailed 354BOOK REVIEWS description of these various communities was given through the use of obituaries, personal and communal histories, photographs, and listing of dowries. The three Poor Clare communities of Rouergue were: Millau (founded in 1291); Granayrac-(1326-1677) moved to Villefranche-deRouergue (1677-1792); and Mur-de-Barrez (founded in 1653). Villefranche began as a rural contemplative monastery, but later moved to the city where they taught young girls and allowed elderly women to live with them. Through the stormy history of the Calvinist revolt and the French Revolution, the Poor Clare communities were dispersed more than once, but they are re-established in Millau and Mur-deBarrez today. Besides the political struggles, the Poor Clares of Millau had a long history of religious controversy and intrigue as well as glory. Presentations are also given on the Annunciationists, another branch of the Poor Clares founded by Jeanne of France and the Franciscan, Gabriel-Maria. These women came to Rodez in 1519. Third Order religious congregations were the first to return to Rouergue after the dispersion of the French Revolution. En virtud de su estatuto ontológico y tecnológico (la conformación inédita de una imagen-tiempo) y de una articulación indisociable entre el orden referencial y el polo pulsional en el Spectator (ligando la fotografía, de manera central, a los procesos inconscientes), la foto posee una potencia singular: la (...) de marcar en el sujeto una intensidad afectiva única. Demostraremos que Barthes comprende la fotografía como el lugar de una experiencia extrema, en cuanto, en el evento del punctum, el Spectator roza el límite del sentido y el advenimento de lo innombrable. In recent decades, a new scientific approach to understand, explain, and predict many features of religion has emerged. The cognitive science of religion has amassed research on the forces that shape the tendency for humans to be religious and on what forms belief takes. We try to find music in everything that permits encoding, insist on giving it a value or precise coordinates in documents, files or more recently, in codes and networks, but there will always be something in music that escapes from language. Historiographical studies have provided a wealth of information on the naturalistic background of medieval political thought, having incorporated Aristotle’s thesis resulting from the reception of Politics. The goal of our study is to provide the hermeneutics of this natural philosophy using as a common thread the body as an attribute of the human constitution which imposes certain needs and from which emerge certain impulses that determine its social and political condition. Specifically, we will analyze the treatises De regno ad regem (...) Cypri and Defensor pacis by Saint Thomas Aquinas and Marsilius of Padua, respectively, regarding how the notion of body is especially important because it is the center of a series of activities which are decisive for life.
